Service Scope: We’ll prepare your tax return based solely on the information you provide. Please note that this service does not include advice or assistance with resolving any tax-related issues.

Identity Verification: As part of our Anti-Money Laundering procedures, we will verify your identity. You will be asked to complete this online. We cannot proceed without successful verification.

Your Responsibilities: You must give complete and accurate information and approve your return before submission.

Eligibility: This service excludes self-employment and partnership returns.

Please review this agreement carefully before using this service. By using this service or by agreeing to these terms, you accept and are bound by this agreement.

This agreement is between Provestor Accounts Ltd, a company registered in England and Wales (company registration number: 10510713), and the individual agreeing to these terms (“User”).

1. Service Description

  • The service includes the preparation and submission of a tax return based solely on the information the User provides through our online software.

  • Provestor Accounts will not provide any advice or resolve any issues with HMRC. 

2. Scope of Return

  • This service is limited to preparation and filing of one Self Assessment Tax Return and excludes self-employment and partnership tax matters. We cannot continue with your tax return if there are any tax matters outside of this scope.

3. User Responsibilities

  • Accuracy of Information: The User is solely responsible for providing accurate, complete, and timely information necessary for the preparation of their tax return.

  • Compliance with Deadlines: The User must ensure all required information is submitted within sufficient time to meet a deadline or as communicated by Provestor Accounts Ltd. Any delays with the User supplying information means Provestor Accounts will not guarantee completion by HMRC deadlines.

  • Identity Verification: As part of our Anti-Money Laundering responsibilities, we are required to verify the identity of all clients. We are unable to begin work on the User's tax return until the identity verification process has been successfully completed.

  • Approval: The User whose return is prepared will be required to check their own return prior to its submissions to HMRC. If a return is prepared and approved by the User then later found to contain errors, a repeat preparation and filing charge will be made to correct the error. If any errors result in additional payments being due to HMRC, Provestor Accounts cannot be held responsible and it is the tax payers responsibility to make the payment to HMRC.

  • Advice: The User acknowledges and agrees within this service that Provestor Accounts Ltd will not provide tax, legal, or financial advice. The service is limited to processing information supplied by the User without any review, analysis, or recommendation.

4. Data and Security

  • The User retains ownership of all data provided during the use of the service. The User grants Provestor Accounts the right to use the Users data for the purpose of performing this agreement.

  • By using the service, the User grants Provestor Accounts Ltd the right to use anonymised data and feedback for research, development, and improvement of the service.

  • Personal data will be handled in accordance with our Privacy Policy.

  • Users must keep their passwords secure and confidential and ensure reasonable efforts to prevent unauthorised access to its account. The User will notify Provestor Accounts promptly of any such unauthorised access.

  • Provestor Accounts implements reasonable physical, technical, and administrative safeguards to protect the Service; however, it does not guarantee that the Service will be uninterrupted, error-free, or immune from compromise.

  • Provestor Accounts may use non-personally identifiable User Data during and after this agreement to enhance the service, for statistical and other business purposes.

5. Limitations of Service

  • This service is limited to the preparation and submission of one self-assessment tax return to HMRC.

  • Provestor Accounts Ltd is not liable for errors or penalties resulting from incorrect or incomplete information provided by the User.

  • The service does not include advice, tax planning, or resolution of disputes with HMRC.

  • Provestor Accounts Ltd reserves the right to decline to provide the service at any stage if it becomes apparent that the User's tax affairs are outside the scope of the service or if fraudulent, illegal, or misleading information is provided.

6. Fees

  • The fee for the service is as communicated at the point of purchase and must be paid in full before any work commences. Fees are non-refundable once the service has begun. If payment is not received, Provestor Accounts reserves the right to suspend or terminate the service.

7. Service Availability and Support

  • The service is available online 24/7, subject to planned or unplanned maintenance. Support is available via email during normal UK business hours. Provestor Accounts will make reasonable efforts to respond to queries within 2 business days.

8. Intellectual Property

  • All intellectual property rights in the software, tools, and materials provided as part of the service remain the property of Provestor Accounts Ltd. The User is granted a limited, non-transferable right to use the service solely for the purpose of submitting their tax return.

9. Confidentiality

  • Both parties agree to keep all non-public information disclosed during the agreement confidential.

  • This includes all data shared by the User and any proprietary information about the service shared by Provestor Accounts Ltd.

10. Term and Termination

  • The term of this agreement is until the date of submission of the tax return of the User.

  • The User may terminate the service by giving written 30 days notice to Provestor Accounts at support@provestor.co.uk.

  • Provestor Accounts may terminate the agreement by giving 30 days written notice to the User.

  • Provestor Accounts Ltd reserves the right to terminate this agreement if:

    • The User fails to provide to Provestor Accounts the required information or evidence necessary to prepare the return.

    • Provestor Accounts believes that the User has broken a law.

    • There is a breach of these terms and conditions by the User.

  • Upon termination, Provestor Accounts Ltd may, at its sole discretion, delete any data provided by the User.

  • Following the termination of this service, Provestor Accounts has no obligation to maintain the Customer Data and may destroy it.

  • If the User is a consumer, they may cancel the service within 14 days of purchase. However, once the service has begun at the User's request, the right to cancel is lost.

11. Limitation of Liability

  • Provestor Accounts Ltd is not liable for indirect, special, incidental, or consequential damages arising from the use of this service, even if it knows of the possibility of such damage or loss.

  • The service is provided “as is,” and Provestor Accounts Ltd makes no guarantees regarding the accuracy, completeness, or timeliness of submissions made on the User’s behalf.

  • Provestor Accounts total liability arising out of or related to this agreement does not exceed the amount that would have been ordinarily paid by User for this service.

  • Neither party is responsible for circumstances beyond its control, including but not limited to force majeure events, except for the obligation to make payments.

12. Indemnity

  • If a third party makes a claim against Provestor Accounts Ltd or requires Provestor Accounts Ltd to respond to legal proceedings arising from the User’s actions, omissions, data, or information within the Software, the User agrees to defend, indemnify, and hold Provestor Accounts Ltd harmless from any resulting damages, losses, or expenses, including reasonable legal fees and associated costs.

13. Governing Law

  • This agreement is governed by the laws of England and Wales.

  • Any disputes must exclusively be brought to and be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Updates to Terms

  • Provestor Accounts Ltd reserves the right to update these terms at any time. Material changes will be communicated to Users via email.

  • This agreement replaces and supersedes all prior discussions and agreements, whether oral or written, regarding the subject matter. Only the terms contained within this agreement are binding.
