These terms explain how letting agents can access and use the Provestor platform to support landlords with Making Tax Digital for Income Tax Self Assessment (MTD for ITSA).
1. Who these terms apply to
These terms apply to any letting agent branch, firm, or individual (referred to as you or the Agent) that creates an agent account or uses the Provestor letting agent portal.
By creating an account, ticking the acceptance box, or using the portal, you confirm that:
you have read and understood these terms; and
you have authority to agree to them on behalf of your business.
If you do not agree, you must not use the portal.
2. About Provestor
Provestor Accounts Limited (Provestor) provides digital software and tools to help landlords meet their Making Tax Digital (MTD for ITSA) obligations.
Provestor provides the platform and tooling.Landlords remain responsible for their own tax affairs, records, and submissions.
3. What this agreement covers (and what it doesn’t)
What it covers
This agreement governs:
your access to the Provestor letting agent portal;
your ability to upload landlord data and send invitations; and
your participation in any affiliate or commission arrangements (if applicable).
What it does NOT cover
This agreement does not:
make you the provider of MTD services;
govern the relationship between Provestor and any landlord; or
appoint you as Provestor’s agent, partner, or representative.
There is no partnership or agency relationship between you and Provestor.
4. Access to the Provestor agent portal
Provestor grants you a non-exclusive, revocable right to access and use the agent portal to support your landlord clients.
You may use the portal to:
upload landlord data and letting statements;
invite landlords to Provestor; and
manage landlord records where permitted.
Provestor may suspend or withdraw access if these terms are breached or where required for security, compliance, or operational reasons.
5. Access fees (MTD Ready)
Access to the agent portal is subject to an MTD Ready access fee, agreed with you separately.
Key points:
the fee applies per agent–landlord relationship;
it applies even if the landlord already has a Provestor account or services;
the fee applies where you want to upload data or manage that landlord through the portal.
The access fee:
is an agent access fee, not a licence for the landlord;
does not create any entitlement to commission; and
does not affect commission attribution.
Multiple agents
More than one letting agent may access the same landlord through the Provestor platform, provided each agent has paid the applicable access fee.
Each letting agent:
may only view and manage the landlord data that they have uploaded or supplied (directly or via an integrated system); and
will not have visibility of data uploaded by any other agent in relation to the same landlord.
6. Commission and incentives
Provestor may offer commission or incentives to some agents in relation to landlords who purchase services beyond the standard MTD Ready service.
All commission arrangements are governed solely by the Provestor Affiliate Commission Policy, published separately on our website.
In summary:
commission is not guaranteed;
commission is not consideration for this agreement;
eligibility, calculation, thresholds, step-downs, renewals, and payment timing are set out in the Commission Policy;
Provestor decides which Commission Policy applies to you (if any).
If there is any conflict between this agreement and the Commission Policy, the Commission Policy prevails for commission matters.
No commission will accrue or be payable after this agreement ends, regardless of prior introductions or activity.
7. Exclusivity
While you participate in the Provestor agent programme, you must not promote, resell, or provide any competing MTD for ITSA solution to landlords.
This restriction applies only to MTD for ITSA services and does not prevent you from offering other property, tax, or accounting services outside that scope.
8. Your responsibilities as an agent
You agree that you will:
only use the portal for lawful purposes;
only upload data you are authorised to share;
keep data accurate and up to date;
manage staff access securely and promptly remove access when no longer required;
not present yourself as the provider of Provestor services;
not promise tax outcomes, compliance, or HMRC acceptance.
You are responsible for how you position your own services to landlords.
9. Landlord data, invitations, and GDPR
Independent controllers
You and Provestor act as independent data controllers under UK GDPR.
Uploading landlord data
You confirm that:
you have a lawful basis to upload landlord data; and
landlords have been informed that their data will be shared with Provestor.
Invitations and emails
When you upload data or request invitations:
Provestor may send emails to landlords directly;
emails will be branded as Provestor;
emails are sent as part of service delivery, not third-party marketing.
CRM integrations
Where you connect a compatible CRM system:
you confirm you have the right to share that data;
data imported via CRM is treated as data you supplied;
Provestor is not responsible for CRM errors, delays, or omissions.
CRM integrations may be added, changed, or removed over time.
Access limits
You will not have access to:
tax return drafts;
tax submissions; or
HMRC filing data.
10. Intellectual property
All software, tools, branding, and content in the Provestor platform belong to Provestor.
You are granted a limited right to use them only while this agreement is in force.
11. Term and termination
This agreement starts when you accept it and runs for an initial 12-month term. It will automatically renew for further 12-month periods unless either party gives notice before renewal.
Either you or Provestor may terminate this agreement with 30 days’ notice.
Provestor may suspend or terminate access immediately if you:
misuse data;
breach these terms;
misrepresent Provestor services;
fail to pay applicable access fees; or
create a security, compliance, or regulatory risk.
12. What happens when this agreement ends
When this agreement ends:
your access to the agent portal stops immediately;
all commission entitlement stops immediately;
the Commission Policy no longer applies to you;
you must stop using Provestor branding and materials.
For clarity:No commission is payable on any service purchased after termination, even if you previously introduced the landlord.
13. Liability
Provestor is not responsible for:
errors in data you supply;
landlord actions or omissions; or
failures of HMRC systems, CRM platforms, or other third-party services.
Neither party is liable for indirect or consequential loss. Nothing limits liability for fraud or for death or personal injury caused by negligence.
14. Confidentiality
You and Provestor must keep confidential any non-public information shared under this agreement.
15. Changes to these terms
Provestor may update these terms from time to time. The latest version will always be published on our website.
If you continue to use the agent portal after changes are published, you are deemed to accept the updated terms.
16. Governing law
These terms are governed by the laws of England and Wales.
